So, a person commits rape and we simply hang him and kill him*? There's no mercy? No forgiving? One may ask! Not any random one, a bench of judges opines the same.
(*Don't call me a female chauvinist or sexist for not using "him or her" there. I haven't come across any instances of women raping men or other genders).
In a recent judgment, Supreme Court commuted the death sentence granted to a rapist, saying "Every sinner has a future".
What BS was that? If every sinner has a future, then what about their victims in the future? They don't need a future? It's not always about the vindication of the past victim (the one who suffered), it's also about the people in the future.
These buggers of so-called compassion (towards the undeserving) have lost it, along with the rapists. A few things from what they said:
"...the maximum punishment prescribed may not always be the determinative factor for repairing the crippled psyche of the offender." -- First & foremost, repairing the crippled psyche is not the primary motto of delivering justice. Sometimes repairing a fellow human is beyond the power of humans. I don't know which form of justice calls for commuting of death sentence. Going by punitive/retributive and even preventive justice, the capital punishment is very befitting for such cases.
This is not a normal instance of rape (And I don't imply that rape can be normal. It goes without saying that rape is an extremely abnormal act). It's a gruesome act of pedophilia where a 4 year old child was brutally raped and murdered! Even if it is an adult in the place of a child, the nature of the crime doesn't change suddenly. It is as ghastly as that. If they couldn't be moved by the suffering of a fellow human, they wouldn't be moved by that of a child either. They are just too insensitive and indifferent to differentiate all that.
Also, if one is looking at rehabilitation and repairing of the convict, many past instances show that rapists don't have the faintest of remorse . The Nirbhaya case is a glaring evidence for that. Same seems to be the case with the family members of the rapists, in general. They don't exhibit compassion either. Same case with the juvenile rapists. Aruna Shanbaug's case is another instance. She was sodomized and left in a vegetative state for the rest of her life and the person who committed it was not convicted of rape, as the laws then did not consider sodomy as rape. Years after the crime, the convict does seem to show remorse, but has a double-talk - on one hand he says he shall ask for forgiveness given his sins and on the other hand he says he did not commit the act he was accused of.
If gruesome rapes are on one end of the spectrum, cheating and raping women in the guise of love are at the other end. The death of the then budding actress Pratyusha in Feb 2002 was one such instance. As far as I can recall from the news back then, on the night of her death she went out along with her lover and his friends, but the news that was out was - it was a suicide pact between her and her lover, as their parents did not approve of their relationship. And that while she succumbed, he survived. There are some movies covering such incidents. (Sarpa Yagam (0:55:00 - 1:11:00), Telugu movie from 1991 to Ghatana (00:45:55 - 1:06:30), 2014 Telugu remake of a Malayalam movie). But how women respond to such incidents changed with time, as it should. From asking their father in the suicide note, to avenge the act, to avenging the act themselves. Movies aside, when it comes to real-life incidents, forget revenge and vindication, the culprits are not even brought to book. They get away with such incidents easily. The acts may not be as gruesome as those discussed in the previous para, but they are heart-breaking and life-destroying, to say the least. "Moving on" with life is not easy if the woman happens to be alive after rape, in such cases.
Coming back to the judgement discussed in the opening para, that a sinner should have a future too, the bench cited this: "Oscar Wilde has said - "The only difference between the saint and the sinner is that every saint has a past and every sinner has a future"." -- Really? Is that the only difference? If Oscar Wilde said that, then damn him and his thoughts, I say! He also said, "I can resist anything but temptation!" So what, I ask!
The voice against capital punishment has been on the rise in India for quite some time and it is not just with rape incidents. (Some very recent commutation orders here). I'd say all those people who have been raising their voices, have also been high on pseudo-compassion. Selective compassion, at that. Where the life of the affected/dead is not of concern, but only those of who are alive. It's like "being alive" is valued highly. People whose lives have been taken away or destroyed at all levels have no value, so to say. To damn with all of them. I reiterate (I said this in the past too, in my blog), the modern society has a very rudimentary understanding of punishment.
Your Honour! (Whoever it is, that is hearing me from above; Readers, please don't bother! Not addressing you here) With all the details submitted above, I unequivocally opine, believe and argue that Capital Punishment is the only right punishment in the above incidents and demand justice. I submit and rest my case here.

If you thought the world needs to deteriorate further, for the judgement to be passed, that the last tree needs to be cut, that the last fish needs to be eaten, that the people should go insane and finally kill each other, then you are completely mistaken. This world is not Godless! The Gods know when and how to take the reins! The Universe will always try and evolve to its best possible state despite all the garbage dumped into it, it could be a zero state too, if you go any further on this small part of a huge system. We don't care if we are going towards a better or worse future from good or bad past as per YOUR parameters of development here on earth, but WE WOULD NOT LIKE TO SEE THIS KIND OF "PRESENT" here!!!"
